You have no recourse from the other driver unless he has full coverage then his insurance should pay for all damages including your deductible. Now the only problem is that this accident gets! reported through a carfax system and the dealer will know your car was involved in an accident so you may get hit with a penalty when you turn the lease back into them. there is also a waiver to be signed asking you if you were involved in any accident with their leased vehicle. The gap insurance covers you if the car was totalled or stolen, it pays the difference of the value of the current Worth of your car at the time it was destroyed and how much you owe on the lease. Troy Staton: I want to say no Nissan most likely will not do that, maybe make the person who hit you or their insurance pay, but ive never leased a car so im not sure and you never know what kind of strange rules they've hidden under some fine print. It looks to me like you did the right thing, lucky your deducible is o! nly 250! and the insurance companies should take it from here.! Your lucky the accident wasnt your fault then you been in bigg trouble !!!
